This Agreement is an official and public offer by the Seller to conclude a sales contract for the Goods presented on the website www.demurehome.com.ua.
This Agreement is public, meaning that in accordance with Article 633 of the Civil Code of Ukraine, its terms are the same for all Buyers, unless otherwise expressly provided by this Agreement or applicable law of Ukraine.
By placing an order on the Online Store website, the Buyer confirms that they have fully read and accept the terms of this Agreement, including the procedures for placing orders, payment, delivery, returns, processing of personal data, and other terms of this Agreement.
The Agreement is considered concluded from the moment the Buyer confirms the order on the checkout page and/or receives an electronic confirmation of the order from the Seller.
1. Terms and Definitions
1.1. Goods – products presented on the Online Store website that the Buyer has selected and added to the cart or purchased remotely.
1.2. Online Store – the website at www.demurehome.com.ua, created to familiarize Buyers with products, place orders, and conclude sales contracts remotely.
1.3. Buyer – a legally capable individual who has reached the age of 18, a legal entity, or an individual entrepreneur placing an order on the Online Store website.
1.4. Seller – Sole Proprietor “Fesak Serhii Volodymyrovych” or another legal entity or individual entrepreneur who publishes product information on the website. The specific Seller is indicated on the product page, in the order confirmation, and/or in the documents provided to the Buyer.
1.5. Demure Home may act as both the seller of its own products and as a platform for размещення products of other sellers or partner brands.
2. Subject of the Agreement and Procedure for Conclusion
2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.
2.2. If another Seller is indicated on the product page, the sales contract for such Goods is concluded directly between the Buyer and that Seller. In this case, Demure Home may act as an informational platform, order processing service, or communication intermediary between the Buyer and the Seller.
2.3. The date of conclusion of the Agreement shall be the date the Buyer places an order on the Online Store website, provided that the Buyer receives an electronic order confirmation.
2.4. The Seller, in cases предусмотрених applicable law of Ukraine, provides the Buyer with a payment document in paper and/or electronic form. The electronic document may be sent via email, phone number, displayed in the user account, or provided by other lawful means.
3. Order Placement Procedure
3.1. The Buyer independently places an order via the shopping cart on the website or by other available means указаних in the contacts section.
3.2. When placing an order, the Buyer must provide accurate contact details necessary for processing, payment, and delivery.
3.3. The Seller has the right to refuse to fulfill an order or request clarification if the provided information is incomplete, inaccurate, or raises reasonable doubts.
3.4. If the Goods are out of stock, the Seller informs the Buyer about possible waiting times, replacement options, or cancellation with a refund if payment has already been made.
4. Price and Payment Procedure
4.1. Prices are determined by the Seller and displayed on the website in UAH.
4.2. Prices may be changed unilaterally. However, the price of fully paid and confirmed Goods cannot be changed.
4.3. Delivery costs, additional services, or payment fees may be indicated separately during checkout.
4.4. Payment is made using available methods: online payment, cash on delivery, or other available options.
5. Delivery
5.1. Delivery is carried out by delivery services or other methods indicated on the website.
5.2. Delivery times depend on the selected method, location, availability, and courier conditions.
5.3. Risk of loss or damage transfers to the Buyer upon receipt of the Goods.
5.4. The Buyer must inspect the packaging and completeness upon receipt.
6. Rights and Obligations
6.1. The Seller must:
- deliver the Goods according to the order;
- provide accurate information;
- protect personal data.
6.2. The Seller may:
- update the Agreement;
- change prices before confirmation;
- refuse orders;
- engage third parties (delivery, payment, CRM).
6.3. The Buyer must:
- review this Agreement;
- provide accurate data;
- pay and receive the Goods;
- inspect Goods upon receipt.
7. Returns and Exchanges
7.1. The Buyer may return/exchange goods within 14 days if unused and intact.
7.2. Governed by Ukrainian consumer protection law.
7.3. Some goods may not be returnable (e.g., cosmetics after opening).
7.4. Defective goods may be returned with proof of purchase.
7.5. Return shipping is paid by the Buyer unless otherwise agreed.
7.6. Refunds are processed after inspection.
8. Liability
8.1. Parties are liable under Ukrainian law.
8.2. Third-party sellers are responsible for their goods.
8.3. Demure Home is not liable for third parties.
8.4. Seller is not liable for incorrect Buyer data.
8.5. Force majeure releases liability.
9. Personal Data
9.1. Buyer consents to data processing.
9.2. Data may be shared with necessary service providers.
9.3. Not shared beyond order purposes.
9.4. Buyer may request changes or deletion.
10. Notifications
10.1. Buyer may opt-in to messages.
10.2. Buyer may unsubscribe.
10.3. Service messages may be sent regardless.
11. Intellectual Property
11.1. All content is protected.
11.2. Unauthorized use is prohibited.
12. Miscellaneous
12.1. Governed by Ukrainian law.
12.2. Disputes resolved via negotiation or court.
12.3. Seller may update terms.
13. Term
13.1. Valid until obligations fulfilled.
13.2. Orders may be canceled if not collected within 30 days.
